There is now a Chief Justice appointed by Bush who may preside over the case. (Although I don't know how this works exactly; I didn't think this kind of case would go before the Supreme Court.)
I could be missing the point entirely, though. :)

there's almost no chance this would end up before the Supreme Court. I don't know of any burning constitutional issue presented here.
And, as I asked above, what would Roberts do that Rehnquist wouldn't?

we don't know for sure what that would be, it could end up in front of the Supreme Court.
As for Roberts vs Rehnquist, we really don't know much about Roberts yet, do we? Except that Bsh likes him.

Look, I'm not trying to read into anything...You asked the question, you obviously had some kind of idea about what you assumed to be an answer...I was just trying to understand what you thought that answer might be. I'm just confused. So if Judy Miller gets out of jail two days ago and Roberts hadn't been confirmed yet, is there not a coincidence?
