The POTUS has the right to nominate whomever he chooses because he earned that right on election day.

He told you he didn't have a litmus test for judges so it would be wrong to expect him to know Miers position on Roe.

Oh, and don't expect the POTUS' nominee to answer any specific questions that could relate to any future cases of the SC.
