The judge should have RULED on recusing himself and let the jerk-off APPEAL fall where it might, instead of looking scared and wimpy and playing defense. He might need O'LOOFAH's book for "kids" on standing up to bullies.

That said, Tom "DePlane-DePlane" DELAY and spa-wifey were arrogant pricks, with their shameless smiles and red dress.

I'm torn about whether she will 1) keep wearing red and fitting in her visits to him in the clink between her spa days or 2) will split and settle for half-sies.

1. The judge is brilliant
don't rule on it - do as he should and pass it on to his superior to make the decision - the superior is documented as having given to Republicans in the past (if he rules that the judge should be recused than his own ruling will be questioned). I love how this is starting and there is nothing wimpy about it.

It just shows more of Delay's hypocracy.

Under TX law a judge asked to recuse can either (1) agree to the recusal or (2) refer it to another judge to make the call, but may not unilaterally refuse to recuse. If you think about it this is eminently fair since the same bias that might warrant recusal would certainly cause a judge to refuse.

On edit: As for an A+ for putting the judge on trial, I would say DeG got the short end of the stick -- on the one hand, he has to make the motion even tho his chances are slim, otherwise he could expect a malpractice suit if and when his client is convicted. On the other hand, he's just informed the judge in essence that he doesn't believe the judge can follow the law.

6. I didn't know that was the law down thar, but it's a sensible one.
If he -was- able to refuse the recusal, I can see avenues for appeal or even a mistrial...

Has to worry about the hammer suing him so is going to be very aggressive and turn this into a circus to protect himself from malpractice? But isn't the goal to get the client off, not protect yourself from malpractice? Who are you protecting in this kind of a situation? Yourself or your client?

Fortunately most judges also realize that attorneys sometimes have to "go through the motions" to protect themselves from future suits, and as long as the attorney doesn't go too far in his arguments, the judge tends to overlook any personal slights.

I once tried to recuse a judge who was the former law partner of my opposing counsel, and was shot down. The judge eventually proved to be quite evenhanded and even gave us a few victories along the way.

I think however it is one thing to ask that the judge step down
because of conflict of interest like you did, another thing to insult and lie about the judge in public like DeG is doing.

8. I don't know about Texas...
but in Alaska a person can automatically ask for a change of judge for whatever reason within the first 10 days (I believe) of his appointment to the case. All you have to do is file a "Notice of Change of Judge" and the presiding judge will automatically assign a new one to your case.
