"TREASONGATE: THE FELONY MURDER RULE - The Iraq War Fraud Could Lead To State Court Prosecutions For Murder American Soldiers
Ordinarily, the President, as Commander In Chief, and his Executive Branch, could not be held legally responsible for the death of US soldiers on the battlefield. But if congressional, military and monetary support for the Iraq war was procured through a fraudulent criminal conspiracy, the Bush syndicate will have no protection from prosecution in state courts -- out of jurisdicitonal reach of the President's pardon power -- which is limited by the Constitution to federal crimes against the United States.

Fitzgerald's court filings appear to have zeroed in on, not just the leak fact pattern, but the Niger document fraud as well. This is massive....the greatest criminal conspiracy in American history:

The fraudulent case to bring our country to war that took the life of 2000 soliders and lined the pockets of Bush's "base". Fact. The Caryle Group is in the business of war. No war, no billion $ contracts, ch ching ching ching.

Attention Frank Carlucci, or should we call you "the architect." Rome is a beautiful city. Carlucci, Ledeen and Armitage. Sounds like a law firm or a" consulting group"? I digress...not really."

3. JANUARY 2001
JANUARY 2001 BREAK-IN AT NIGER EMBASSY

At night, between the first and second of the January 2001, a mysterious thief came to the embassy of Niger in Rome and into the residence of the counselor in charge. It turned out that some letterhead and seals (see photocopy) were missing. A second dossier on Niger-Iraq trade soon came into Martino’s hands, one that included references to uranium trafficking. Martino claims he got it from embassy personnel and that he thought it was authentic.

6. Kick, just to see some of the lawyers weigh in, I'd love for it to be
some type of charge that * couldn't pardon. The last time this crowd got away or got pardoned - they just came back and their entire base thinks they're the next best thing to Jesus Christ.

16. A lawyer weighing in: Sorry, but it won't happen
The underlying fact is that the decision about going to war is committed to Congress and the President. A state court doesn't have the authority to, in effect, review the correctness of that decision. No state court would go out on that limb, and if one did, the federal courts would slap them down.

As a general rule, do you want state court judges to have broad power to review the actions of federal elected officials? There were probably some conservative states where an ambitious prosecutor could've gotten an indictment of Jimmy Carter over the Panama Canal treaty.

12. Presenting fraudulent 'circumstances' and 'situations' in War Powers Act
of 1973 for openers leads to the ginned-up "intelligence" and the domestic media abuse of Operation Mockingbird.

This leads us to abuse of federal agencies, like the CIA, which was one of Nixon's impeachment offenses.
