Red Cross: Israel's use of white phosphorus not illegal

GENEVA

The international Red Cross said Tuesday that Israel has fired white phosphorus shells in its offensive in the Gaza Strip, but has no evidence to suggest it is being used improperly or illegally.

The comments came after a human rights organization accused the Jewish state of using the incendiary agent, which ignites when it strikes the skin and burns straight through or until it is cut off from oxygen. It can cause horrific injuries.

The International Committee of the Red Cross urged Israel to exercise "extreme caution" in using the incendiary agent, which is used to illuminate targets at night or create a smoke screen for day attacks, said Peter Herby, the head of the organization's mines-arms unit.

"In some of the strikes in Gaza it's pretty clear that phosphorus was used," Herby told The Associated Press. "But it's not very unusual to use phosphorus to create smoke or illuminate a target. We have no evidence to suggest it's being used in any other way."

In response, the IDF said Tuesday that it "wishes to reiterate that it uses weapons in compliance with international law, while strictly observing that they be used in accordance with the type of combat and its characteristics."

Herby said that using phosphorus to illuminate a target or create smoke is legitimate under international law, and that there was no evidence the Jewish state was intentionally using phosphorus in a questionable way, such as burning down buildings or consciously putting civilians at risk.

It'd totally spoil my impression of Israel's defenders in it's time of need, faced with this "existential threat" -- that even one of them would recoil this abomination going down.

And besides, those streamers look so cool, with the F-16s streaking away.
Ya think the IDF should leave even one building standing? Or ya think that'd just leave work for the armored bulldozers, after the Palestinian diaspora is complete?

It wasn't easy, but I found a cached copy from yesterday. It's a huge url, but it does confirm that Jerusalem Post changed the header from "Red Cross: ...." to "IDF ...."

Small point, but while people are being shake'n baked to death, what the hell, all of us "lovely people" can argue about angels dancing on the heads of pins.

12. The burn cases you refer to do not appear to be from WP
White phosphorus burns thru flesh and muscle to the bone, leaving distinctive deep holes and smoldering wounds that cannot be extinguished with water. The skin-burn cases being used for the propaganda you refer to show none of these identifying signs. Even the Palestinian Doctors making this claim seemed to realize it wouldn't stand up, hedging their statements with a disclaimer that they didn't know what WP burns look like. The Red Cross does know what it looks like, and would not have made this statement if they had seen any actual cases.

Researchers in Israel from the rights group witnessed hours of artillery bombardments that sent trails of burning smoke indicating white phosphorus over the Jebaliya refugee camp in northern Gaza. But they could not confirm injuries on the ground because they have been barred from entering the territory.

The chief doctor at Nasser Hospital in southern Gaza said he treated several victims there with serious burns that might have been caused by phosphorus. He said, however, that he did not have the resources or expertise to say with certainty what caused the injuries.

The substance can cause serious burns if it touches the skin and can spark fires on the ground, the rights group said in a written statement calling on Israel not to use it in crowded areas of Gaza.

WP causes deep smoldering wounds, not wide surface burning.

"serious burns that might have been caused by phosphorus. He said, however, that he did not have the resources or expertise to say with certainty what caused the injuries."

So he didn't say that they WERE caused by WP, just suggested that they MIGHT be just because they were burns, and then covered his ass professionally for the misleading statement by saying he lacked the expertise to know.

with burns consistent with WP. As they were not there when these burns occur, these doctors usually include a caveat in their statements because they are more careful than the IDF.

But, taken together, these doctors' reports with the video clips that have now gone all over the world plus the IDF refusal to deny they are using WP in civilian areas, add up to, the IDF is knowingly using WP in civilian areas.

19. It comes down to this
as long as Israel did not directly fire the WP at people or dwellings but simply near them even knowing the "collateral" the use of WP is in the strictest terms legal. However I have now asked a couple of folks I know with military backgrounds about the use of WP as a smokescreen and was told yeah it can be used as that, but it is by no means the effective smokescreen nor the cheapest there are other more effective ways.
What is important here for some is that it is legal under the law the collateral is is really a who cares I don't as long as it looks good

....is that theres no evidence of it being illegally used.

If I murdered my wife, kept investigators (in this case journalists) away from the crime scene, and force fed the prosecutors (in this case the media) only my version of events, it doesn't make what I did less illegal, or NOT ILLEGAL. It just makes me one hell of a killer.

WP shell would cause no damage, where did it explode in the middle of a concrete football field and it would leave chemical residue wouldn't it?

64. ICRC: Israel's use of white phosphorus not illegal
GENEVA – The international Red Cross said Tuesday that Israel has fired white phosphorus shells in its offensive in the Gaza Strip, but has no evidence to suggest it is being used improperly or illegally.

The comments came after a human rights organization accused the Jewish state of using the incendiary agent, which ignites when it strikes the skin and burns straight through or until it is cut off from oxygen. It can cause horrific injuries.

The International Committee of the Red Cross urged Israel to exercise "extreme caution" in using the incendiary agent, which is used to illuminate targets at night or create a smoke screen for day attacks, said Peter Herby, the head of the organization's mines-arms unit.

"In some of the strikes in Gaza it's pretty clear that phosphorus was used," Herby told The Associated Press. "But it's not very unusual to use phosphorus to create smoke or illuminate a target. We have no evidence to suggest it's being used in any other way."

65. they don't have evidence that Israel is using it illegally.
In any case, whether or not it's legal, that doesn't justify its use. Of course if Israel hadn't launched this attack, they wouldn't be using WP at all.
