The Fed ct will affirm removing schiavo's feeding tube. What then? |

The possibilities are two fold:
1. The christian right will be satisfied that there has been another examination that all parties received due process under Florida law, and resign themselves to the fact that death is what Terri wanted; or
2. The christian right will campaign against an activist federal judiciary that murdered little Terri, demand that there be a vote in Congress making it illegal to remove a feeding tube ever, invalidate State laws to the contrary, and set up an adminstrative review process to examine each and every person on life support to make sure that if anyone dies, there is an investigation to make sure that the hospital staff is prosecuted.
That's why I think the repubs are going down on this one. They have oversold this legislation as "saving" Terri. It won't, and when it doesn't, they are going to have some splaining to do to a constituency that feels its extremist theocratic views have already been made into law.

incite people to violence against judges. Republicans have created a dangererous climate for judges. The demonizing of judges by Bush and other republicans is going to have an effect on some people who are dangerously unbalanced such as Tim McVeigh, Ann Coulter, and Tom DeLay. Democrats should introduce some bills in Congress to increase security for judges and their families to protect against the increased risks created by those who are demonizing judges.

The founding fathers set up the judicial branch for a reason. It was not to rubber stamp the other two branches, people. It was to be an independent review of the law and it's too damn bad if some people don't like some of their decisions. I'm afraid it will lose alot of power because of this crowd.

I think most people, when they really think about it, realize that what the Republican-dominated congress did was unconstitutional. There are very few people who have never had a relative or friend in Schiavo's condition, and most people have silently prayed for the "passing" of the person. Certainly, most people wouldn't want to be vegetables themselves, and they sure as hell wouldn't want Congress to decide their fate. By attracting so much attention to this whole thing, the Republicans have just opened up a can of worms they'll wish they never opened.

they and the RW radio to be in full "appeasing the masses" mode for the next day or two. I expect them to have Delay and the others on all over the place with the "Remain calm All is WELL" "We did everything we could" storyline.

3. Democrats are blamed for blocking 10 Bush nominees.
In other words - this will be played many many times during the Bush judicial nominations.

they have oversold the law just passed. Right wing christians think that Terri really should be kept alive and that this law does it.
What will happen when the law is exposed for what it is: a superficial review of the procedures in the state court?
At the moment, the repugs have it both ways: they pretend to the right wingers that they have kept Terri alive, and pretend to the alarmed nation that all they are doing is having another review.
The republicans have pandered to the right wing and now cannot take it back. Delay argued that Terri is suffering and referred to "her passion". How do you now weigh that against federalism?
The repugs have a bear by the tail.

The law Jeb manuvered in Fl was struck down as unconstitutional, and I don't see any difference with this one. As I understand it, no law can be established to apply to only ONE PERSON! I heard DeLay say this was a very narrow law and would only apply to Terri. As soon as he said that, I breathed a sigh of relief. This legislation will go down in flames the same as the on in Fl!

a moderate or left-leaning. There's no way any judge can rule anything but uphold the FL court's decision. Then, here it comes, more "acivist judges" legislating from the bench. We need to remove the "activist's" and get the "Strict Constructionist" judges in.

With a lot of DC up late last night (including reporters) this is a prime chance to pull Rove/W's old "Data dump" when everyone goes home early or are watching the court in Tampa.
