Isn't this an easy way to de-rail Miers nomination??? |
|
Miers is a self-described evangelical christian, yes?
By being such, she could not swear an oath to uphold the constitution as the 'law of the land'. She answers to the higher law of the evangelical christian and could put no law above her faith.
Game. Set. Match.
(saw this on another board, but sound quite simple, yes?)

Scalia and Thomas are devout Catholic Christians, and I'm not sure about the others. It is irrelevant.
We shouldn't go there, unless the candidate's views indicate that she would not protect Constitutional right and the basic acceptace of separation of church and state.
If we start demanding atheists as justices, we have lost.
On the other hand, if her religion prevents her from recognizing established law concerning equal rights and privacy, that is something else.
Let's be careful.

4. The Constitution prohibits any religious test for office. |
|
That includes any test to disavow one's faith.
