Proposed Law Would Take Away Driver's License Permanently
Law Named After Drunken-Driving Crash Victim

SACRAMENTO, Calif. -- In 2003, a Galt teenager's life was cut short by a drunk driver -- a woman who had driven drunk before. But the teen's name may live on if lawmakers pass new legislation.

At the state Capitol Monday, Steve Williams joined with Assemblyman Ross Bogh, R-Yucaipa, to announce the introduction of a bill known as "Adam's law," which would permanently take away the driver's license of anyone convicted three times of felony DUI.

California already has some of the toughest drunken-driving laws in the nation, with third-time offenders facing up to 10 years in prison, even more if someone is hurt. But victims' advocates say that currently no state goes so far as to take away an offender's license with no chance of ever getting it back.

But some Democrats say the worst drunken drivers would still get behind the wheel, even without a license. And they say "Adam's law" might even make the problem worse by taking away drunken drivers incentive to get sober in order to get their license back.

If they don't realize they have a problem after TWO offenses, they shouldn't be driving.

13. Don't we already have enough unlicensed drivers on the road
And if they are not licensed, they also don't have an incentive to have insurance.

2. I'm not sure that this is a bad idea.
If my child were killed by a drunk driver and then I came to find out that that person had been arrested three previous times for drunk driving, I would want some answere also.

3. With conviction of a 3rd felony DUI they shouldn't be out of prison.
You have to be pretty drunk (at least here) to get a felony DUI. And 3 of them? You are a danger to everyone.

4. I support a choice. 3rd no felon DUI and you go to rehab, jail or lose it.
minor aside...does every law have to have an individual's name tacked to it. I understand the emotion, but jeez...

6. Three times? Amateur.
There are some drunks here in New Mexico who have more than ten DUIs. I think the record is up around 20. It doesn't do any good to take their licenses away, they just continue to drive without them. It does little good to put breathalyzer ignition interlocks into their cars, since they just dump the cars in favor of new ones or get a kid or grandkid to blow into it when they're ready to go.

The city has only recently started to impound the cars of anyone convicted of multiple DUIs. I think that might be what is needed to slow these jokers down.

Notice this is different from drug forefeiture because the drunk has to be convicted before the car is sold at auction. You don't even have to be charged with a crime to have your property taken from you under the forefeiture statutes.

7. Not enough. People drive around without licenses. They have to be
put in jail...or something else has to be done to make it absolutely impossible for them to get behind the wheel of a car...or to be able to consume alcohol.

10. Stiffer sentences and impounding are more effective solutions

Make the minimum 20 years, plus five for each injury and ten for each death. And I like that car impounding idea--that will help ensure that people will be careful about who they loan their cars to.

11. I say take the DL away after just ONE DWI. It's that serious.
A bicyclist was just killed around Sonoma County by a drunk driver. I ride a bike, and the thought of some drunk driver who clearly doesn't give a damn....well, I have NO MERCY for them!

It's not like there are been no warning about DWI....sheesh!!! I say grab the DL for at least 10 years. They may have to move to the city and take the bus....but hey, tough luck!

14. DUI suspect arrested 7 times before
A suspected drunken driver arrested March 28 in connection with a bicyclist's death has been convicted of driving under the influence in Sonoma County four times since 1983, court records show.

Joseph Lynchard, 72, of Santa Rosa also was arrested three times for DUI in the 1970s, according to sheriff's records. But because those cases are so old, it's unknown whether the arrests led to convictions.

Despite that history, the former backhoe operator and truck driver had a valid license when he allegedly swerved in his Ford F-150 pickup and plowed into Kathryn Black, killing the 43-year-old Clearlake woman.
