An Open Letter to Barack Obama
Move Fast to Restore the Rule of Law
By RALPH NADER


Dear President-Elect Obama:

You have been receiving a great deal of advice since November 4, 2008 from people and groups who either want you to advance policies not covered in your campaign or who want you to be more specific about initiatives you emphasized.

There are two suggestions which may not be among your store of recommendations that need to be considered before you take office on January 20, 2009.

First, the public would benefit from a concise recounting of the state of the union and where the Bush Administration has left our country. As is your style, you can render such a bright line of serious problems inside and outside the government in a matter-of-fact manner. Otherwise, a blurring of who was responsible for what can taint your presidency.

Second, you need to make a clean break from the Bush regime's law of rule to our declared commitment to the rule of law as in the firm adherence to constitutional requirements and statutory and treaty compliance. There is a Bush-Cheney stream of criminal and unconstitutional actions which are on auto-pilot day after day. You have pointed out some of these abominations such as a policy and practice of torture and violations of due process and probable cause. The task before you is to break these daily patterns just as soon as you ascend to the Presidency or be held increasingly responsible for them. This can be significantly accomplished by executive orders, agency or departmental directives, whistle-blower protections, enforcement actions and explicit legislative proposals.

With Americans wishing you well in this most portentous of times, the last thing they want to see is you tarnished by the preceding rogue regime and its ruthless monarchical forays. To avoid this contagion of power over law and its contiguous accountabilities at a time when you are striving for a clean slate administration, you must be decisive and eschew any excessive harmony ideology which has seemed to be your nature vis-à-vis those who are powerful but are opposed to your views.

One possible impediment to your making a comprehensive clean break for restoring the rule of law is that you have too easy an act to follow. There are a long list of violated civil liberties that need to be restored (the American Civil Liberties Union has compiled a list of immediate actions for you to take), and resolute commitments must be made so that it is clear the United States, for example, will not engage in, or countenance, torture. Only a few restorations, however, would produce a sense of relief and flurry of accolades -- but they are hardly sufficient.

There are also regulations and interpretations of statutes that scholars believe to have been erroneous as a matter of law. As one guide for your new era of overdue regulation or reregulation, given the corporate wrongdoing these days, you may wish to refer to the Center for Progressive Reform's report By the Stroke of the Pen.

The Bush lawlessness and state terrorism are like a contagious disease. If you do not remove their sprawling incidence, you will become their carrier. This means you must move fast to eject the mantle of war criminality and repeated unconstitutional outrages committed in the name of the American people here and abroad.

Without that clear and bright break, more people will say there is no difference between the parties or they will say Obama agrees with some of what bush did or had no problem with the violations.

If you think that 700,000 is "very few people" you might have a point.

However, the election is over and I think even more people will seriously consider his views given his credentials in fighting for consumers and working people.

Well, back to the subject. What do you think about the points he raised in his letter to President-Elect Obama?

The scapegoating of Nader was done by Democrats who didn't want to defend

the 2000 election against Bush's illegal moves.

And, Florida includes 300,000 DEMOCRATS who voted for Bush --

Plus 3,000 + votes which went to Buchanan on "butterfly ballot" approved

by Democrats!

Not to mention a fascist GOP rally to STOP the recount in Miami-Dade County with

no interference from police --

Followed by the Supreme Court taking the decision out of the hands of the Florida State

Supreme Court and putting Bush in WH ---

Yeah -- all of that was Nader's fault --

but it seems what you intended to be understood.

And, yes, the attack on Nader as an opponent of "government for sale" was

purposeful to try to cause loss of confidence in him.

Nader, however, has provided all the political information we argue and

debate with today. Nader has been arguing against corporatism for decades.

For national health care and getting insurance companies removed. And,

every other issue we are fighting for or against.


I hope you don't think that election 2000 is the only reason his support has dwindled over the years.

And the use of the word "only" here suggests that you are being disingenuous.

And still misunderstand what happened in 2000.

And here's a reminder ...

It's a farce --

Gore won no matter how you count the votes ...

Including Florida where a handful of votes decided the race --

Other third parties took thousands of votes --

More than 600 "illegal" ballots were counted for Bush --

More than 3,000 "butterfly" ballots went to Pat Buchanan --

We had a GOP "false flag" riot that STOPPED the vote counting in Miami-Dade

County MANDATED by the Florida Supreme Court. No police interference.


AND, finally US Supreme Court Gang of 5 undermined the Florida State Supreme

Court ruling and gave decision to Bush.


HOW could you ignore all of this and buy the propaganda that it had anything to

do with Nader --???????????????????????????????????

Like people like me, who still see no difference between the repukes and the democrats much of the time, didn't have the right to vote for whomever we wanted

Like Nader and all third-party candidates, and the people who voted for them, were somehow supposed to "know" that Bush would steal the election and run an entirely lawless, mass murdering, war mongering administration and therefore "should not" have run, "for the public good" and to make people like you (who mean zilch, nada, zero, nothing to me and everybody else) somehow "happy"

If people voted for Nader in such huge numbers that the Democrats lost, well, then, maybe the Democrats better look at their platform and give the people what they want instead of repuke lite and corporatist handouts and back-patting. People like Rahm Emmanuel and the rest of the DLC fake Democrats surrounding Obama give me little hope that things will be much different now.

Depending on how things go for the next four years, there is a good chance I will permanently register as an Independent and just turn my back on the "business as usual with some marginal social programs to make it look good" Democrats. So you can blame me and people like me who might vote third party--or you can blame the Democrats for being simply the flip side of the Bush Family Republican Party coin (why are Bill and Bush Sr soooo friendly now?)

22. No matter what you think of Nader this is damned good advice and its essential Obama heed it.
I think it would be wonderful if at his next press conference someone would ask him if he has read the letter yet and if not to present him with a copy of it. There should be no cloak of ignorance for the incoming Obama team to hide behind, they can not say "no, sorry, we haven't had a chance to see it yet"; the favored excuse of politicians asked about programs they do not have strong support for.

Obama, Kerry and Gore accepted millions of dollars in Republican money during their campaigns. I don't think they destroyed the rule of law.

38. There is a great deal you can criticise Nader for, but it is good advice.
Nader has become his own Frankenstein's Monster, victim to his own sense of importance. We should not discount an accurate assessment however, just because of it's source. If Obama is intelligent enough to see this then I think he will be one of the better presidents we have had.

Why don't you blame the DEMOCRATIC enablers of "what happened"?

How many Democrats, besides Dennis Kucinich, actually worked to really change anything? How many, EVEN NOW, would hold the repukes accountable for "what happened"? How many voted for Bush's carte blanche on Iraq, on wiretapping, on FISA, for billions in budget to murder innocent Iraqis as well as US troops, and have remained quiet and complacent, enabling torture, death by Katrina, and so many other egregious sins for the past 8 years?

Wasn't it a Democrat who (really outside of her lawful responsibilities) set the agenda by saying impeachment was "off the table"?

"What happened" is that Democrats were paid well for their good ole boy acquiescence to Bush's lawless regime. NOT ONE (with the notable exception of Dennis Kucinich) had the balls or the guts to even TRY to expose them or bring them to justice.

But since YOU choose to blame it on Nader, who merely ran for public office as a third-party candidate while somehow KNOWING "what was going to happen," and people ACTUALLY VOTED FOR HIM (WHY????)--well, it must all be "Nader's fault"

If you hadn't shoved your "No difference between the parties" bullshit into the 2000 election, we wouldn't have been in this situation in the first place.
