On Jan. 7, 2021, a group of forensics experts working for lawyers allied with President Donald Trump spent eight hours at a county elections office in southern Georgia, copying sensitive software and data from its voting machines.

Under questioning last month for a civil lawsuit, a former Georgia Republican Party official named Cathy Latham said in sworn testimony that she briefly stopped by the office in Coffee County that afternoon. She said she stayed in the foyer and spoke with a junior official about an unrelated matter at the front desk. “I didn’t go into the office,” Latham said, according to a transcript of her deposition filed in court. Surveillance video footage reviewed by The Washington Post shows that Latham visited the elections office twice that day, staying for more than four hours in total. [...]

A Post examination found that elements of the account Latham gave in her deposition on the events of Jan. 6 and 7, 2021, appear to diverge from the footage and other evidence, including depositions and text messages.

“I didn’t go into the office,” Latham said, according to a transcript of her deposition filed in court. She said she had seen in passing a pro-Trump businessman who was working with the experts. She said they chatted for “five minutes at most” — she could not remember the topic — and she left soon after for an early dinner with her husband.


It turns out that there is surveillance video of the incident showing that she was lying through her teeth. She greeted the Trump delegation and repeatedly went into the office where they were illegally copying data. "She took a selfie with one of the forensics experts before heading out at 6:19 p.m." It doesn't help Ms. Latham's case that she signed on as a GA fake elector for Tump.

Said her lawyer after being shown the surveillance video “Failing to accurately remember the details of events from almost two years ago is not lying.” Actually, that is a matter for a jury to decide after an indictment. Being that it is southern GA, jury nullification is her best hope.

Over the weekend, in a rally on Saturday in Ohio, Trump made it clear that he is no longer playing with a violent, extremist base, but rather cultivating it. In the days before the event, he “retruthed” posts from the conspiracy theory QAnon, whose followers believe that he is leading a secret war against pedophiles and cannibals and that he will soon be placed back into power, arrest his Democratic enemies, try them, and execute some of them. That moment of his return is called “the Storm,” and one of his “retruths” assured his audience that “The Storm is Coming.” The rally played the QAnon theme song—or something so like it as to be indistinguishable from it—and featured other QAnon-adjacent politicians.

Trump seems to know he is down to his last line of supporters, and he is rallying them to be ready to commit violence on his behalf, much as he did in the weeks before January 6, 2021. But the rally appeared to have attracted only a few thousand people, a far cry from the crowds he commanded when he was in office. His power resides now primarily in his ability to deliver or withhold his supporters, whom the party desperately needs. In exchange for delivering his supporters, Greg Sargent of the Washington Post points out, Trump seems to be demanding that a Republican Congress put an end to his legal troubles.

I think people are making a grave mistake of applying principles of law to Trump’s legal maneuvering.

Trump’s lawyers are not making arguments about law.

If there were lawyers concerned about principles of justice participating in his defense, they’d be stridently advising him to work on a plea deal admitting guilt to 18 USC 2071, removing government documents, maybe even agreeing to the probably unconstitutional part of the law that would prohibit him from running for President again, in exchange for removing the more serious 18 USC 793 and 1519 charges from consideration. Such a plea deal is never going to happen. Win or lose, Trump is pursuing power, not adjudication under the law, not even recognition of the law.




This schedule ensures that key decisions come to a head in mid-November, after the election.

Trump’s goal here is not any final determinations from Dearie (absent a determination that the FBI was mean to Trump just like they were to Carter Page). Cannon’s order fairly obviously invites Trump to contest Dearie’s ultimate decisions so she can de novo decide the issues. Trump’s goal is undoubtedly (because it always is) to create conflict, to sow an invented narrative that DOJ is out to get him. And Trump’s optimal outcome is not necessarily even that Cannon will say Trump declassified all these documents, including some of the Intelligence Community’s crown jewels. Such a proposition might even piss off a few of the Republicans who’ve not entirely lost their mind, until such time as Trump convinces them through the process of repetition and demonization that the IC should never have been spying on (say) Russia in the first place.

Trump’s goal here is to sustain the conflict until such time as Jim Jordan can save him, and the two of them can resume their frontal assault on rule of law again.

TO RECAP: Trump demanded a special master and won. He asked for Raymond Dearie and won. Now his legal team is upset that Dearie is asking for evidence of what he claims to have declassified and is setting aggressive deadlines.

Trump has 3 immediate problems with Dearie:

1) He sets a fast deadline that vets all the records by Oct. 7

2) He asks Trump for details of what he claims to have declassified

3) He suggests Reinhart might have to preside over 4th amendment suit

IMPOTUS bargain with GOP: I give you my base, you place me above the law.

This is why we can’t vote for a single Republican for any office, anywhere in this country. If we want rule of law, let alone humane and pragmatic policies, it’s essential that the Republicans be removed from power at all levels of government.

Don't overlook this. Trump's Ohio rally was unhinged, but he also delivered a clear message: He fully expects a GOP Congress to shut down any/all investigations into him. The bargain with the GOP is this: I give you my base, you place me above the law.

At the JD Vance rally, Trump unleashed an unhinged rant about all the investigations into him. Then he said:

The Guardian: Proud Boys memo reveals meticulous planning for 'street-level violence'

Document of 23 pages shows the lengths to which the far-right group goes to prepare for potentially violent encounters and exposes the militaristic structure and language it has adopted

The document is so dowdy and formal it resembles the annual minutes of a society of tax accountants. Its index lists sections on “objectives” and “rules of engagement” and carries an “addendum” that provides recommendations for hotels and parking.

On the cover, two words give a clue to the notoriety of the group that produced it: “MAGA” and “WARNING”. That and the date: 5 January 2021, the day before the US Capitol attack.

What goes unsaid on the cover and is barely mentioned throughout the 23 pages is that this is the work of one of the most violent political gangs in America, the far-right street fighters who Donald Trump told to “stand back and stand by”: the Proud Boys.

The document, published by the Guardian for the first time, gives a very rare insight into the meticulous planning that goes into events staged by the far-right club.

The Department of Justice lawyers working on the appeal and stay in the “documents case” of Mar-a-Lago and Donald J. Trump for the 11th circuit are smart. The ones trying for a stay from Cannon were smart, too, and smarter than she is.

Marcy Wheeler, at Empty Wheel blog, notes that, in their appeal, they drop a note that Donald Trump has leaked top secret material. I’m going to add emphasis:

Aileen Cannon’s order only permitted the government to review the classified documents for hypothetical risk of future disclosure. It notes that that would prohibit the government from investigating whether these documents have already been disclosed. It then raises the empty folders as a problem that must be solved, in part by identifying the patterns of Trump’s theft to identify what else he may have stolen.

The injunction also appears to bar the FBI and DOJ from further reviewing the records to discern any patterns in the types of records that were retained, which could lead to identification of other records still missing. See A42 (describing recovery of “empty folders with ‘classified’ banners”). And the injunction would prohibit the government from using any aspect of the seized records’ contents to support the use of compulsory process to locate any additional records.

Disregarding a sworn declaration from a senior FBI official, the court dismissed such concerns as “hypothetical scenarios” and faulted the government for not identifying an “emergency” or “imminent disclosure of classified information.” A11. But the record makes clear that the materials were stored in an unsecure manner over a prolonged period, and the court’s injunction itself prevents the government from even beginning to take necessary steps to determine whether improper disclosures might have occurred or may still occur.


As she says,

The government came very close to saying that Judge Cannon has prohibited the government from preventing leaks in process.


This is short for Empty Wheel, so think it through for a moment. Justice, on behalf of FBI, is saying that the materials were held for months without security. There are empty folders. The empty folders MUST be investigated, but Cannon prohibits the investigation, since those would be “hypothetical” and of things in the past. She is only allowing a security review of future harms.

So, a Fake Rothschild, someone looking for a towel and opening the wrong closet, or just K$$$ and John Solomon evacuating the good stuff but leaving the wrapper? The jackets without files tell us that there are Top Secret goods that HAVE leaked. They may or may not have been transmitted, but they have escaped containment and governmental control.

The Espionage Act case has already been proved.
