Microsoft Defies Federal US Court Order To Disclose Customer’s Overseas Email

Microsoft is flat out ignoring a federal court order to provide U.S. prosecutors access to a customer's emails being held on a server in Ireland. For Microsoft, this boils down to a matter of trust with its users, and so long as the case continues to maneuver through the appeals process, the Redmond outfit has no intention of complying with the order.

Judge Loretta Preska, chief of the U.S. District Court in Manhattan, ruled back on July 31 that Microsoft was required to hand over the email messages to U.S. prosecutors investigating a criminal case. However, she temporarily suspended the order so that Microsoft could appeal.

Prosecutors have since argued that her order was not a "final, appealable order," and since Microsoft hadn't been held in contempt, no reason exists to enforce the stay. Preska agreed with that assessment, saying her order "merely confirmed the government's temporary forbearing of its right to stay enforcement of the order it secured," and that "the fact that the court has not closed the case cuts against Microsoft's argument" that her order was final and could be appealed.

In other words, the prosecutors got their wish in terms of having the judge side with them and order Microsoft to hand over emails, but as far as Microsoft is concerned, federal authorities don't have jurisdiction over data stored outside the U.S., giving it legal ground to ignore the order.

You will wonder what the hell this has to do with "Loners group", but I think you'll see.

I play an online MMORPG game, by myself. I'm not going to name it, so I don't get harassed by the idiots of the world. Long story short, someone called me a "douche" in the game. I don't think I deserved being called that name. I cried real tears in real life. No one has ever called me that nasty name in my entire life. Yes, I'm overly sensitive. Yes, I need to grow a rhinoceros hide.

Yes, I know in the grand scheme of things, being called a douche is nothing. Absolutely nothing. However, can't we all be kinder to each other ? That includes me too. Today just reminded me, once again, to be KIND, as much as humanly possible.

with all due respect, Earl, I think a section of the TOS on both DU and Discusionist devoted to misogyny would be wonderful. You administrators still have the final say on who gets banned and suspended, but at least it's there in black and white for trolls to look up on Google. If people don't understand what misogyny is, then a fruitful discussion can be had on both sites. I'm not naive enough to believe that 100% of all posters will always be in 100% agreement on what the precise definition of misogyny is, but if I were running DU and Discussionist, that's what I would do.

floors and sound

I don't have an immediate issue with this, just a question. I've stayed in hotels where I could not hear any sound whatsoever from the room above me. At the other extreme, I've had apartments where the flies walking would produce sound.

What sort of construction is required, to soundproof the floor for the occupants directly underneath ? Just curious, as always. Thanks.
