(17,174 posts)25. If the Pentagon determines that articles of the UCMJ have been violated by a retired military member,
they can be recalled to active duty for the purpose of prosecution, but in this case, there is no violation of any articles of the UCMJ, he didn't say to disobey legal orders, he said it's their duty to disobey ILLEGAL ORDERS, emphasis on illegal.
Technically, I guess I could be recalled for wearing this T-Shirt:

However, I don't think even Kegsbreath would go that far.

IIRC, 80 years ago it was firmly established that "I was just following orders" was not a viable defense.
