This is kind of a black swan event. There's a Latin phrase which applies to the dismissals for this reason that means roughly "turns back time." How much time it turns back is not agreed on by the lawyers I have read and listened to. It might indeed turn back the statute of limitations long enough to re-indict Comey. If so, his lawyers would be seeking dismissal on the grounds of selective and vicdictive prosecution, and heaven knows that's true.
But they would still have to convene a grand jury and get it to approve the indictment. This DOJ is definitely not able to get a grand jury to indict a ham sandwich.
