If folks will not respect one anothers' rights then one cannot expect to have those rights. This battle MUST be fought in the court of public opinion otherwise you will win in the courts and then the legislatures and the public will amend their state constitutions and remove those rights from the books after which you'll have to go back and fight for public opinion like you should have done in the first place, and THEN you'll have to get the blasted laws BACK ONTO the books, on top of that.
