38. Because 100,00 of the uncounted ballots disappeared
Blackwell made them disappear. Kerry was going to challenge based on the fact that he was about 120,000 votes behind *, and there were 250,000 uncounted ballots. Shortly after the call was made to Blackwell, suddenly there were only 150,000 ballots. The statistical chance of getting 120,000 of those was tiny, and Kerry's legal team told him the challenge could not change the outcome of the election. Only after determination was made did he concede.
