when you waterboard them. In other words, its not a PUNISHMENT, its an INTERROGATION method, so every prisoner who is waterboarded is not known to be guilty of anything when they are waterboarded.
now, they might confess to something they did or didn't do in order to stop the torture, but at the point it is decided to waterboard them, they obviously have no evidence at all or they wouldn't need to torture.
The whole idea of torture is to force a confession through pain. guilt or innocence is really irrelevant.
