Permit Holder shoots man who attacked him while he was stopped at an intersection

Gregory began battering the driver, deputies said, striking him repeatedly before appearing to reach behind his back. Fearing his assailant was armed, deputies say the driver took action.

The driver, a concealed-weapon permit holder, drew a gun and fired, deputies said. The shot struck Gregory in the area of his upper torso, near his shoulder.

Gregory was taken to Orlando Regional Medical Center. He was expected to survive his injuries, and to be booked into the Orange County Jail upon his release.

not to mention uncivil can one be to an innocent attacker.

3. The article does not say if the attacker was in fact armed.
The driver/shooter will almost certainly be sued. At least he would be in my state.

The lawyer will ask 'why didn't the driver drive away'? - the attacker was on foot.

But - the article sucks and provides no analysis or detail. Hard to tell what happened beyond the most basic facts.

5. He won't be sued in FL.
They have Castle Doctrine and Stand-Your-Ground laws with civil immunity clauses.

7. In some (free) states you have no duty to retreat.
Someone attacks you, you have the right to defend yourself.

You don't have to run away and hope they don't chase you.

As you say, the article was sorely lacking in detail. Be that as it may, there's no way in hell, were I on the jury, you'd get to me to vote in favor of the plaintiff because the defendant chose to defend himself instead of fleeing.

You don't want to get shot, keep your fucking hands to yourself.

16. I am NOT arguing against self defense. I am saying the article suggests
that the attacker was armed - was he?

It also suggests that the shooter was injured - what was the extent of his injuries? How was he injured? Was treatment required?

No mention of whether or not he could have simply drove away.

No mention of the type of firearm, number of shots fired.

Not that any of this negates the right to self-defense, but these are questions that immediately come to mind.

Reasonable fear of a violent attack is sufficient justification for the use of deadly force.

The reporter should provide the details of the report - without bias.

On edit - this story could have been written from an evening TV news report.

It's tabloid fodder.

14. Having deja vu of Gordon Hale, III
Hale was the first person issued a Concealed Handgun License in Texas to shoot and kill someone, Kenny Tavai.

Early reports sounded like a simple fender bender led to Hale killing Tavai in a fit of road rage. Why didn't he just drive off? Why didn't he just stop and exchange information for the minor accident? Blah-blah-blah.

Months later, when the grand jury refused to indict, a completely different image emerged.

Side view mirrors of the two vehicles apparently clipped one another, but it was unclear who was at fault. Hale did not realize this, or maybe he drove off and failed to stop intentionally, but Tavai did notice and drove after Hale. Hale stopped at a red light, cars in front, to each side, and Tavai's vehicle pulled up behind and stopped. Tavai told his passenger, upon exiting his vehicle, "I'm going to kick some ass." Tavai got to Hale and began striking him in the face. Hale stated while Tavai was striking him repeatedly in the face, he was seeing stars and feeling like he about to go unconscious. That was when he shot. Hale suffered a partially detached retina from being struck by Tavai.

but you're not going to last long here with that attitude.

There's not enough info to determine that he merits death, and perhaps this incident will suffice to make him re-assess his life path.
