This video of an Indiana health inspector trespassing is everywhere |
|
Any Indiana folks know what happened? Or if it is even a trespass? I've had my con law and property classes, but I am not sure if a health inspector is a lawful exception to the trespass rule (generally trespass statutes say no trespassing "for any unlawful purpose" or some such thing, I am wondering if a health inspector is a "lawful purpose" or if this is a straight-up due process violation). http://www.break.com/index/sheriff-allows-illegal-trespass2b.html

Amendment 4 - Search and Seizure. Ratified 12/15/1791.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The guy was trying to install an illegal septic system. If it was in his single-wide, he'd have a point. It wasn't. But you are correct, if partially; half the story is everywhere.
