Fatal shooting in quarrel over Iraq ruled self-defense

PRESTONSBURG - A Floyd County grand jury has declined to indict a local resident who killed a Clay County man at an Eastern Kentucky flea market last summer during an argument over the war in Iraq.

After interviewing 18 witnesses since September, the panel this week issued a two-page "no true bill," indicating it concluded that Doug Moore, 65, of Martin acted in self-defense on Aug. 4 when he shot and killed Harold Wayne Smith, 56, of Manchester.

At the time, it was thought to be one of the first deaths in the U.S. stemming from divisiveness over the war.

"I know a lot of interest in this case is because of the Iraq War angle," said Turner, who received phone calls from newspapers across the country about the case.

"But that issue doesn't really have an impact on the legal aspects of the case," he said. "Their argument is significant in that it led to the incident, but the substance of the argument didn't really make a difference."
