Officials: Mom got daughter abortion to hide rape

(08-30) 16:02 PDT HOUSTON, (AP) --

Authorities have accused a Houston woman of getting an abortion for her adopted 12-year-old mentally disabled daughter in order to hide evidence of her son's alleged sexual assault of the girl.

The woman is charged of tampering with evidence for taking her daughter to a clinic in Cleveland, where she had an abortion on Oct. 22.

Her 19-year-old son was indicted earlier this year on three counts of aggravated sexual assault of a child.

Isn't it equally possible that the mom got her daughter the abortion to prevent her from being a 12-year old mentally disabled mother? How are they going to prove criminal intent?

I do sympathize with the DA's disappointment that the case against the son is probably gone -- but consider the alternative!

But clearly the DA is disappointed that the mother didn't think it was a good idea to put her daughter through a pregnancy and childbirth in order to get his "evidence." How does THAT make sense?

2. I agree with the child getting an abortion--it was the best course of action.
But mom also needed to turn her son in, difficult as that may have been. Sad situation.

22. Thats assuming of course she knew he was the father, she is under our law presumed innocent until
proven guilty just like anyone else regardless of our own personal beliefs.

4. Foster care system is worse than institutions of old which were more 'transparent'
Privatization of care for disabled, retarded and elderly makes them more likely to be victimized than the publically owned and operated 'homes' which used to be.

foster home and the state was any good at taking care of clients - the mother would have had to get court permission to have this abortion. The child is vulnerable. And if you do not think rape happened in institutions then you have not been paying attention. Clients in institutions were often raped both by other clients and by staff.

10. I could believe that she didn't know if...
she hadn't gone all the way to Ohio, that needs further explanation. It's a horrible thing to have to turn in a family member, but it is seriously wrong to not do so, I can't understand how she could want to protect her son more than her daughter. Perhaps she shouldn't have adopted children in the first place.

suspicion that it was her son who did it to the girl then you are right, if however the DA has proof that she did know or suspect her son did it then shes an accessory to the crime and should be charged as an accomplice.

19. If she suspected her son,
letting her daughter have the baby would have been the RIGHT thing to do? How is that "protecting" her son, anyway? Why shouldn't she protect her daughter, too?

20. I did not say that I disapproved of the abortion
As for protecting her son she may as the DA spelled out their claim which is that she took the girl out of state to do the abortion in order to get rid of the evidence that it was her son who was the father and no I'm not saying I agree with the DA just that is what they are claiming.

from becoming a 12-year old mentally disabled mother, period. And maybe she went out of state so she wouldn't be burdened by delays and stupid sonogram laws. In effect, the DA (not you) is asking me to believe that she committed the crime of being more interested in protecting her son than protecting her daughter. There's just too much built-in reasonable doubt.

25. And I agree that may be why she did it.
I cannot say for sure though just like I cannot say she did or did not know if her son was the father of the baby, all i am saying basically is if and thats "if" she did know that he was the father and or suspected he was that imo atleast that I doubt that she acted in the best interests of the girl.
And keep in mind I am only saying thats "if" she knew or suspected but I am not saying that I believe her guilty.

28. If she wanted to protect her daughter, why didn't she call the police?
If no one could identify and prosecute the person responsible for the child abuse and pregnancy in the first place, there is the risk it could happen again. Calling the police would help assist in preventing future abuse from taking place.

27. She should have contacted police, and THEN taken her daughter to the clinic
A pregnant, mentally disabled 12-yr old is clear evidence of severe child abuse. Even if she didn't suspect her son, why didn't she call the police so that they could open a case on it first? The police would have no say in whether or not she then took her daughter to have an abortion.

The fact that she didn't call the police seems to indicate that she did have some idea of what was going on and that she was trying to protect her son.
