The SCOTUS refusing to hear this case rests squarely on Roy Moore's shoulders. Moore's attorneys appealed the wrong thing. They should not have appealed the ruling itself but rather should have appealed whether or not the Federal Judge even had juridiction in the case.

The SCOTUS made the right call, they have no business deciding a state issue -- had they heard this appeal they would have been setting precedence that would have furthur broadened things that "Speration" could cover. The appeal should be that the Fed Judge should have never heard the case in the first place.
