Andy Kim Sues to Block Preferential Treatment on Ballots in Senate Race

Representative Andy Kim, a Democrat running for Senate in New Jersey against the state’s first lady, filed a federal lawsuit on Monday that seeks to redesign the ballot before June’s contentious primary election, arguing the current layout unfairly benefits candidates supported by party leaders.

The complaint aims to topple New Jersey’s longstanding ballot-design process, which is unique to the state, by asserting it violates the constitution and permits voters to be “cynically manipulated.”

The legal maneuver is a direct attack on the governor’s wife, Tammy Murphy, who is Mr. Kim’s chief opponent in the Democratic primary and is likely to benefit most from the way ballots have traditionally been designed in 19 of the state’s 21 counties.

And it is certain to intensify public debate over the use of “the line,” the preferential ballot position that allows party leaders to bracket their preferred candidates for all races in a prominent column or row. Unendorsed candidates appear off to the side, in a nearby row or at the ballot’s edge, a location commonly referred to as “ballot Siberia.”

Mayor Adams backs NYC sanctuary law change to easily deport immigrants 'suspected' of crimes

Mayor Adams came out in favor of modifying the city’s sanctuary status laws Tuesday to make it easier for his administration to help federal authorities deport immigrants suspected of crimes — embracing a policy prescription mostly espoused by conservatives amid the local migrant crisis.

The sanctuary laws, which date back to the 1980s, prohibit city government workers and agencies from helping federal immigration authorities with tracking down and detaining immigrants residing in the five boroughs for deportation purposes.

There are exceptions to the sanctuary laws that allow the city to cooperate with the feds in some cases, including if an immigrant has been convicted of a serious or violent crime. Existing laws do not, however, permit the city to cooperate with federal immigration authorities if a foreign national has merely been accused of a crime.

In a Tuesday afternoon press briefing, Adams said the current laws are too lax and that he wants to return to a standard that was in place under former Mayors Michael Bloomberg and Ed Koch. Under that standard, the city could cooperate with federal authorities, including by detaining immigrants on their behalf for deportation, if they were “suspected” — not only convicted — of crimes

Indiana justices, elections board kick GOP US Senate candidate off primary ballot

INDIANAPOLIS (AP) — The bipartisan Indiana Election Commission voted unanimously Tuesday to remove one of two Republican U.S. Senate candidates from the primary ballot, and the state Supreme Court rejected his legal challenge to the law barring his candidacy.

The decision to remove John Rust from the ballot leaves U.S. Rep. Jim Banks as the only GOP candidate for the seat.

Rust had sued state officials over Indiana’s law requiring that candidates must have voted in their party’s past two primaries or received the approval of a county party chair in order to appear on the primary ballot.

State Legislature proposes new congressional map (NYS)

Democratic lawmakers on Monday once again upended the redistricting process when they rejected a bipartisan proposal for new congressional districts in favor of drawing their own. The Legislature’s proposed map, released early Tuesday morning, is far less bombastic than the last time they attempted to draw their own maps in 2022, nudging some districts further to the left while offering relatively minor changes to the plan Democrats voted down. But as legislative Democrats appeared to play it safer, in hopes of avoiding yet another redistricting lawsuit, others in the party were left wishing they had taken bigger swings.

The Legislature’s newly-released map makes some districts a little more blue than the bipartisan Independent Redistricting Commission’s map would have done, including the 3rd Congressional District on Long Island, recently won by Democrat Tom Suozzi, and the 19th Congressional District in the Hudson Valley, held by Republican Rep. Marc Molinaro. The legislative proposal also keeps the Independent Redistricting Commission’s proposed changes to the 22nd Congressional District in Central New York, held by Republican Rep. Brandon Williams, that would also bump up Democrats’ favorability for the seat based on 2020 election results.

On the primary side, a tweak to the 16th Congressional District held by Democratic Rep. Jamaal Bowman would place Co-Op City back into his district, while removing part of the Wakefield neighborhood of the Bronx. That could play a role as he attempts to fend off a primary challenge from Westchester Executive George Latimer.

Lawmakers introduced and promptly amended the new redistricting bill on Monday before midnight, meaning that legislators can vote on the new congressional lines as soon as Thursday. They could vote even sooner if Gov. Kathy Hochul offers a message of necessity, which would waive the three-day aging period usually necessary for legislation. Although the bill history says all changes were made before midnight, the amended language was not actually made available until the early hours of Tuesday morning.

Steve Kornacki: Why Trump wins independents in polls while struggling with them in primaries

Donald Trump is winning his primaries handily and has a virtual lock on the Republican presidential nomination — but a common interpretation of the results says that he is also exhibiting profound weaknesses among independents that portend dire general election consequences.

But there’s a hitch. A look at general election polling reveals a completely different story among independent voters — and a dive into all the other data we have on the 2024 presidential race shows why Trump’s poor independent numbers in the primary and better performance in general election polls are completely consistent with each other. The short answer: These are two very different groups of voters.

First, the evidence for Trump’s weakness among independents voting in this year’s GOP primaries is straightforward. Despite the widely acknowledged — even by his critics — inevitability of his nomination, Trump is still losing around 40% of the vote in Republican contests. And he’s getting crushed among independents, a group that looms large in November. From exit polling data, here’s how bad Trump’s numbers have been with them so far (note that exit polls weren’t conducted in Michigan):

For context, Trump lost the independent vote to President Joe Biden in 2020 by a 9-point margin, 52%-43%, per the NBC News national exit poll. So the current general election polling actually indicates slight improvement for Trump (and a decline for Biden) among independents, albeit with a significant number indicating they don’t want either candidate.
